Puducherry consumer commission backs Edelweiss Tokio Life on suicide exclusion
The Puducherry State Consumer Commission held that Edelweiss Tokio Life was right to refuse two loan-linked death claims under a one-year suicide clause, setting aside a district order.
Key points
- The Puducherry State Consumer Disputes Redressal Commission allowed Edelweiss Tokio Life Insurance's appeal on 28 October 2026.
- The policies, with sums assured of Rs 15 lakh and Rs 10 lakh, paid only 80% of the premium on a suicide within one year, the order records.
- The commission held the clause must be applied as written, so the family gets no death benefit; the order may be appealed.
The Puducherry State Consumer Disputes Redressal Commission on 28 October 2026 set aside a district commission order that had directed Edelweiss Tokio Life Insurance to pay two loan-linked life cover claims. The commission held that the policies' suicide clause, under which only 80% of the premium is refunded if the insured dies by suicide within one year of cover starting, must be applied as written.
What Happened
A borrower and her husband had taken two housing loans, of Rs 15 lakh and Rs 10 lakh, from Edelweiss Housing Finance, now Nido Home Finance. Two life policies with the same sums assured were taken in the husband's name to cover the loans. According to the order, he died by suicide in September 2018, about four to six months after cover began. The insurer refused the death claims and refunded 80% of the premiums to the lender, and the Insurance Ombudsman upheld that decision in July 2020.
On 27 February 2026 the District Consumer Disputes Redressal Commission, Puducherry, held that the real cause of death was depression that followed a road accident and illness, and ordered the insurer to pay the sums assured, less the refunded premium, with 9% interest. On the insurer's appeal, the state commission disagreed. It held that the clause makes no distinction based on the insured's state of mind, that a consumer forum cannot add exceptions the contract does not contain, and that depression, even severe, is not by itself unsoundness of mind. It found no deficiency in service, because the insurer acted under a clear term and gave written reasons.
What It Means
For families of borrowers, the order shows how strictly a suicide exclusion in a loan-linked life policy can be enforced: within the stated period, the insurer may pay only what the clause provides. The commission said it was conscious of the hardship to the family but had to apply the contract as agreed. It noted that the clause appeared in the certificate of insurance, under a heading a reader would examine, which is where policyholders can find such terms. The order is the state commission's finding and may be appealed.
