The Securities and Exchange Board of India (SEBI) used Circular No. SEBI/HO/MIRSD/MIRSD-PoD/P/CIR/2025/132, dated 30 September 2025, to replace a single go-live date for retail algorithmic trading with a three-step glide path for stock brokers. The circular extends the implementation of SEBI's 4 February 2025 framework on "Safer participation of retail investors in Algorithmic trading", and it remains the reference document for anyone who places orders through a broker's API, whether through an in-house tool or a third-party algo vendor. The full text is on the SEBI circulars page.

This pre-open note does not quote Nifty, Sensex or sectoral index levels, because no verified closing data was available to the desk for this edition. What follows is a regulatory snapshot: the dates, milestones and consequences written into the circular itself, and what they mean for retail traders who rely on automated strategies.

Market Snapshot

The core facts of Circular 2025/132 fit into one table. Every date below comes from the circular text published by SEBI on 30 September 2025.

Applicable to all brokersWith effect from 1 April 2026
Legal basisSection 11(1) of the SEBI Act, 1992, read with Section 30 of the SEBI (Stock Brokers) Regulations, 1992

The framework applies to retail orders routed through a broker's application programming interface (API). Paragraph 1 of the circular records that the 1 August 2025 start was first moved to 1 October 2025 after "representation from stock brokers and algo vendors". Paragraph 3 records that a "majority of the stock brokers" told SEBI they needed more time to change their systems after the exchanges revised their operational modalities in September 2025.

Rather than push the whole framework back a second time, SEBI split brokers into two groups on 30 September 2025. Brokers whose systems were ready went live on 1 October 2025. Brokers that were not ready were placed on the glide path in the next table.

MilestoneDeadlineWhat the broker must do
Milestone 131 October 2025Apply to the exchange for registration of retail algo products coming through API (in-house and through vendors) and at least one algo strategy
Milestone 230 November 2025Complete registration with the exchange of retail algo products coming through API (in-house and through vendors) and a few algo strategies
Milestone 33 January 2026Participate in at least one mock session with the new functionality "complete in all aspects", and give the exchange evidence of participation
Consequence5 January 2026Brokers that miss the milestones are barred from onboarding new retail clients for API-based algo trading
Full applicability1 April 2026The February 2025 framework, implementation standards and exchange modalities apply to all stock brokers

Under paragraph 4, the mock-session calendar for Milestone 3 was to be set by the exchanges. A broker that had not taken part by 3 January 2026 had to tell its exchange so. Under paragraph 6, the stock exchanges, not SEBI directly, monitor broker compliance with all three milestones.

What Moved Yesterday

No verified price or volume data for the previous session reached this desk, so this section tracks movement in the rulebook rather than in stock prices. Five dated steps led to the 30 September 2025 circular, and each one changed what retail algo users could expect from their brokers.

30 September 2025Glide path with three milestones; ready brokers go live 1 October 2025Circular 2025/132

The first move was the deferral of 29 July 2025. It gave brokers 2 more months, from 1 August 2025 to 1 October 2025, after brokers and algo vendors argued that the systems work was larger than expected. The circular states that this extension was granted "based on representation from stock brokers and algo vendors".

The second move came from the exchanges. Their 22 July 2025 operational modalities set out how the framework would work in practice, and the clarifications issued in the second half of September 2025 changed some of those details. Paragraph 3 of Circular 2025/132 links the need for more time directly to those September changes.

The third move was SEBI's choice of structure on 30 September 2025. A blanket deferral would have delayed the framework for every broker; the glide path instead let ready brokers start on 1 October 2025 while setting checkpoints 31, 61 and 95 days later for everyone else. Paragraph 7 also asked brokers that were not ready to report their number of existing clients as on 30 September 2025, giving exchanges a baseline for supervision.

The fourth move was the penalty. Paragraph 5 bars a broker that misses the milestones from onboarding new retail clients for API-based algo trading from 5 January 2026. The bar is aimed at new clients only; the circular does not, in its text, order brokers to disconnect existing API clients.

The fifth move was the end date. Paragraph 8 states that from 1 April 2026 the framework, implementation standards and exchange modalities "will be applicable for all stock brokers". As of this note on 17 October 2026, that date is more than 6 months in the past; readers should check the SEBI circulars archive for any later circular that amends it.

What to Watch Today

For a retail trader running an automated strategy, Circular 2025/132 turns into four practical checks. None of them requires a market view; each depends on the broker's own compliance record against the dates set on 30 September 2025.

1. Whether your broker went live on 1 October 2025 or used the glide path. Paragraph 4 split brokers into these two groups. A broker that used the glide path had to meet all three milestones, ending with the 3 January 2026 mock session, to keep onboarding new retail API algo clients after 5 January 2026.

2. Whether your strategy is registered with the exchange. Milestones 1 and 2 required brokers to apply for, and then complete, exchange registration of retail algo products and strategies by 31 October 2025 and 30 November 2025 respectively. A strategy that is not registered through the broker sits outside the framework the exchanges supervise under paragraph 6.

3. Whether you trade through a vendor. The circular expressly covers retail algo products coming through API "in-house and through vendors". If you use a third-party platform connected to your broker's API, the broker is the entity answerable to the exchange for that product's registration.

4. Whether you are a new or existing API client. The 5 January 2026 bar in paragraph 5 restricts onboarding of new retail clients by brokers that missed the milestones. An existing client of such a broker should ask the broker directly about its status rather than assume either outcome.

The wider calendar also matters for traders who automate leveraged positions. The RBI Monetary Policy Committee raised the repo rate by 25 basis points to 5.50% on 7 October 2026, with the stance moved to "calibrated tightening"; the next review is scheduled for 2 to 4 December 2026, according to the RBI press release of 7 October 2026. Funding costs for margin positions tend to follow policy rates, so the December meeting is a dated event to note.

Tax treatment does not change because an order was placed by an algorithm. Short-term capital gains on listed equity attract tax at 20%, and long-term gains at 12.5% above an annual exemption of Rs 1.25 lakh, under the rates applicable since Budget 2024. Frequent automated trading can also raise the question of whether gains are business income rather than capital gains, a classification that depends on the facts of each case.

For investors who would rather not run strategies at all, the comparison is worth making in numbers. A monthly investment of Rs 10,000 can be modelled over any horizon with the SIP calculator, a one-time amount with the lumpsum calculator, and an annually rising contribution with the step-up SIP calculator. These tools use your own assumed return rate; none of them predicts market returns.

FAQ

What is SEBI Circular 2025/132?

It is SEBI circular SEBI/HO/MIRSD/MIRSD-PoD/P/CIR/2025/132, dated 30 September 2025. It extends the implementation timeline of SEBI's 4 February 2025 framework on safer participation of retail investors in algorithmic trading and sets three milestones for brokers that were not ready on 1 October 2025.

What were the three broker milestones?

Brokers had to apply for exchange registration of retail API algo products and at least one strategy by 31 October 2025, complete registration of those products and a few strategies by 30 November 2025, and take part in at least one complete mock session by 3 January 2026, with evidence given to the exchange.

What happens to a broker that missed the milestones?

Under paragraph 5 of the circular, such a broker is barred from onboarding new retail clients for API-based algo trading with effect from 5 January 2026. The exchanges monitor compliance under paragraph 6.

When did the framework become applicable to all brokers?

Paragraph 8 states that from 1 April 2026 the February 2025 framework, along with implementation standards and the exchanges' operational modalities, applies to all stock brokers. Check sebi.gov.in for any later circular before relying on this date.

Does the framework cover algo platforms run by third-party vendors?

Yes. The milestones expressly cover retail algo products coming through API "in-house and through vendors", so vendor-built products connected to a broker's API need exchange registration through the broker.

How many times was the start date deferred?

Twice in substance. The original 1 August 2025 date was moved to 1 October 2025 by the circular of 29 July 2025, and Circular 2025/132 of 30 September 2025 kept 1 October 2025 for ready brokers while giving others a glide path ending with full applicability on 1 April 2026.

Are profits from algo trading taxed differently?

The circular does not deal with tax. Under rates applicable since Budget 2024, short-term gains on listed equity are taxed at 20% and long-term gains at 12.5% above Rs 1.25 lakh a year; whether frequent trading counts as business income depends on individual facts.
