The e-filing portal will not let a taxpayer upload their own tax audit report. If your turnover or gross receipts have crossed the Section 44AB limits for FY 2024-25, the report on Form 3CB-3CD can be filed only by a Chartered Accountant you first assign on the portal, who then accepts the assignment and signs the form with a Digital Signature Certificate (DSC). This guide walks through who files what, when the 30 September deadline bites, and the exact assign-accept-file sequence that each returns a Transaction ID.

The Scenario

Picture a freelance architect whose professional gross receipts reached Rs 72 lakh in FY 2024-25 (assessment year 2025-26). That figure sits above the Rs 50 lakh ceiling for a profession under Section 44AB(b) of the Income-tax Act, 1961, so a tax audit is now compulsory. The architect is an individual, not a company, and no other statute requires their books to be audited.

That last fact decides the form. Where accounts are not required to be audited under any other law, the audit report is furnished on Form 3CB-3CD; where they already must be audited under another law (for example a company audited under the Companies Act, 2013), the report goes on Form 3CA-3CD instead. The Income Tax Department's Form 3CB-3CD help page states that only one of the two applies to any given taxpayer.

The practical shock for most first-time audit cases is procedural, not arithmetic: the taxpayer cannot press "submit" on this form at all. Section 44AB, introduced by the Finance Act of 1984 with effect from assessment year 1985-86, requires the report to be signed by a Chartered Accountant, and Rule 6G prescribes the forms. On the portal that translates into a two-party workflow where the taxpayer assigns and the CA files.

Statutory Answer

Section 44AB fixes who must get accounts audited. The thresholds that trigger it for FY 2024-25 are set out below; all three trace to the text of the section on India Code.

TaxpayerSectionAudit trigger (FY 2024-25)
Business44AB(a)Total sales, turnover or gross receipts exceed Rs 1 crore
Business, low-cashFirst proviso to 44AB(a)Limit raised to Rs 10 crore where both cash receipts and cash payments are 5% or less of the total
Profession44AB(b)Gross receipts exceed Rs 50 lakh

The Rs 10 crore relief is not automatic. The first proviso to Section 44AB(a) lifts the Rs 1 crore limit to Rs 10 crore only where aggregate cash receipts do not exceed 5% of total receipts and aggregate cash payments do not exceed 5% of total payments; miss either 5% test and the Rs 1 crore line applies. This higher limit has stood at Rs 10 crore since FY 2021-22.

Rule 6G splits the report in two: Form 3CB is the auditor's certificate on the books, and Form 3CD is the statement of particulars. Per the Income Tax Department's help page, Form 3CD runs across Part A (clauses 1 to 8) and Part B (clauses 9 to 44), and the utility lets the CA proceed to Part B only after Part A is filled and saved.

Timing is governed by the "specified date" in Section 44AB read with Section 139. For a taxpayer subject to audit, the audit report must be furnished by 30 September 2025 for assessment year 2025-26 (one month ahead of the 31 October income-tax return due date for audited assessees). Furnishing the report late, or not at all, attracts a penalty under Section 271B of 0.5% of total sales, turnover or gross receipts, capped at Rs 1,50,000.

Two registration prerequisites decide whether the filing can even start. Both the taxpayer and the CA must be registered on the e-filing portal with an active PAN, and the CA must hold a valid, active DSC because the form is uploaded under digital signature; the help page lists DSC as mandatory for the CA, and flags linking PAN with Aadhaar as recommended. If PAN and Aadhaar are not linked, a pop-up warning appears at the CA's acceptance step.

Worked Resolution

Return to the architect with Rs 72 lakh of gross receipts for FY 2024-25. Because that exceeds the Rs 50 lakh profession limit in Section 44AB(b), Form 3CB-3CD is mandatory, and the deadline is 30 September 2025. Here is the end-to-end portal sequence, each stage of which issues a Transaction ID to retain.

StepWho actsPortal pathOutput
1. Assign CATaxpayerDashboard > e-File > Income Tax Forms > File Income Tax Forms > Form 3CB-3CDTransaction ID on success
2. Add / pick CATaxpayerAuthorized Partners > My CA > Add new CA (or "Existing CAs")CA linked to PAN
3. AcceptCADashboard > Pending Actions > Worklist > "For your Action" > AcceptTransaction ID on acceptance
4. FileCAWorklist > "Pending for Filing" > File Form (upload via Offline Utility, sign with DSC)Acknowledgement

Walk the figures through. The architect logs in, opens File Income Tax Forms, selects Form 3CB-3CD, chooses the filing type and assessment year 2025-26, assigns the CA and attaches the balance sheet and profit-and-loss account. The portal returns a Transaction ID; this is step one and the form is now out of the taxpayer's hands. The CA then fills Form 3CD's 44 clauses in the Offline Utility, logs in, finds the assignment under Worklist, clicks Accept (a second Transaction ID), and finally clicks File Form and uploads with a DSC before 30 September 2025.

Now price the cost of missing it. The Section 271B penalty is 0.5% of gross receipts. On Rs 72 lakh that is Rs 36,000 (0.5% of Rs 72,00,000), which falls under the Rs 1,50,000 statutory cap and so is payable in full. Had the architect been a trader with Rs 4 crore of turnover, 0.5% would be Rs 2,00,000, but the cap would pull the penalty back to Rs 1,50,000. Either way the late report is a direct, avoidable cash loss, separate from any interest on tax.

The audit report is a precondition to, not a substitute for, the income-tax return. Once the CA files Form 3CB-3CD by 30 September 2025, the architect still files the ITR by 31 October 2025, reporting the same professional income. Model the resulting liability on Oquilia's income tax calculator and compare the two regimes on the old-vs-new regime calculator; where the practice deducts TDS on vendor or contractor payments, the TDS calculator helps size those deductions before clause-by-clause reporting in Form 3CD. For the terminology, see Oquilia's glossary entries on the assessment year, the income tax return and gross total income.

FAQ

Can I file Form 3CB-3CD myself without a CA?

No. Section 44AB requires the audit report to be signed by a Chartered Accountant, and on the portal only a CA assigned by you and holding an active DSC can accept and file Form 3CB-3CD. The taxpayer's role ends at assigning the CA and attaching documents, which generates the first Transaction ID; the acceptance and filing both happen from the CA's own login.

What is the difference between Form 3CA-3CD and Form 3CB-3CD?

Form 3CA-3CD is used where the accounts are already required to be audited under another law, such as a company audited under the Companies Act, 2013. Form 3CB-3CD is used where no other law mandates an audit, which covers most individuals and firms crossing the Section 44AB turnover or receipt limits. Form 3CD, the 44-clause statement of particulars, is common to both; only the auditor's certificate differs.

What is the due date to furnish the tax audit report for AY 2025-26?

The report must be furnished by 30 September 2025, which is one month before the 31 October 2025 income-tax return due date for taxpayers subject to audit. The audit report is filed first; the return follows. Do not wait for the return deadline, because the report has its own earlier cut-off.

What penalty applies if the audit report is late?

Section 271B imposes a penalty of 0.5% of total sales, turnover or gross receipts, subject to a maximum of Rs 1,50,000. On gross receipts of Rs 72 lakh that works out to Rs 36,000; on a turnover large enough for 0.5% to exceed Rs 1,50,000, the penalty is capped at Rs 1,50,000. The penalty is additional to any interest on tax paid late.

Does the Rs 1 crore business limit ever rise to Rs 10 crore?

Yes, but only on a cash test. Under the first proviso to Section 44AB(a) the Rs 1 crore limit becomes Rs 10 crore where both aggregate cash receipts and aggregate cash payments are 5% or less of the respective totals. If either cash figure exceeds 5%, the Rs 1 crore threshold applies and audit is triggered at the lower level.

Do I need a Digital Signature Certificate as the taxpayer?

The mandatory DSC is the CA's, because the CA uploads and signs Form 3CB-3CD under digital signature. The Income Tax Department's help page lists an active DSC as a prerequisite for the CA. Separately, linking your PAN with Aadhaar is recommended; if it is not linked, a pop-up appears when the CA tries to accept your assignment.

What are the two parts of Form 3CD?

Form 3CD is split into Part A, covering clauses 1 to 8, and Part B, covering clauses 9 to 44 of the Income-tax Act, 1961. The Offline Utility lets the CA move to Part B only after Part A is completed and saved, so incomplete particulars in the opening clauses will block the rest of the report.
