GSTN revises GST cancellation process, allows approval without an officer

The GST Network said on 1 November 2026 that applications to cancel GST registration in Form GST REG-16 will be approved electronically, without an officer, when the prescribed conditions are met.

Key points

  • The GST Network has revised the self-cancellation process for GST registration filed in Form GST REG-16, adding system checks.
  • Regular taxpayers with output tax liability of Rs 2.5 lakh or less in each tax period get electronic cancellation if returns are filed on time.
  • Above Rs 2.5 lakh in any period, the final return GSTR-10 must be filed within three days, or the case goes to the tax officer.

The GST Network (GSTN), which runs the GST portal, has revised the process for businesses that apply to cancel their own GST registration in Form GST REG-16. In an advisory dated 1 November 2026, it said the portal will now run system checks and, where the conditions under rule 20 of the Central GST Rules, 2017 are met, approve the cancellation electronically, without a tax officer stepping in.

What Happened

Under the revised process, the portal first checks whether the taxpayer has filed all returns due on or before the effective date of cancellation given in the application. The application can be submitted only if all such returns have been filed. Where a business has furnished outward-supply details in Form GSTR-1 or the Invoice Furnishing Facility for a tax period, it must also file the GSTR-3B return for that period.

If returns up to the effective date are not yet due, the application moves to a "Pending for Returns Filing" stage, and the taxpayer must file them by their due dates. If they are not filed in time, the application goes to the jurisdictional tax officer.

When the returns are filed on time, composition taxpayers, non-resident taxable persons, OIDAR taxpayers and input service distributors will have their registration cancelled electronically. For regular, casual and SEZ taxpayers, the portal checks the output tax liability, the tax due on their supplies, for each tax period. If it is Rs 2.5 lakh or less in every period, cancellation is electronic. If it exceeds Rs 2.5 lakh in any period, the taxpayer must file the final return, Form GSTR-10, within three days, and cancellation is electronic only if that deadline is met.

What It Means

Small businesses closing down can have their GST registration cancelled without waiting for an officer, provided every return is filed on time. The three-day window for Form GSTR-10 is counted from the due date of the returns in the "Pending for Returns Filing" stage or, where that stage does not apply, from the date the application is submitted. Missing it sends the case to the tax officer. Where an officer cancels the registration, Form GSTR-10 must still be filed within 90 days of the effective date of cancellation, wherever applicable, under the existing process.
