Bengaluru police probe GeekLurn over loans raised in students' names

Bengaluru City Police are investigating GeekLurn Edutech under Crime No. 133/2023 over allegations that education loans were raised in students' names; two accused have anticipatory bail.

Bengaluru police probe GeekLurn over loans raised in students' names

What the Record Shows

The Jayanagar Police Station, Bengaluru City registered Crime No. 133/2023 against GeekLurn Edutech Service Pvt Ltd and its office-bearers on a complaint by Sri Satyendra Madhukar dated 29 May 2023, invoking Sections 406, 420, 504 and 506 read with Section 34 of the Indian Penal Code. The complaint, as recorded in subsequent Karnataka High Court orders, alleges that the company advertised a data-science course on a "zero cost EMI" and "pay after placement" basis and then processed a personal loan in the complainant's name, without his informed permission, before stopping the promised payments.

According to contemporaneous press reports, the company's founder and managing director, Kamalapuram Srinivas Kalyan, was arrested in early June 2023 after the complaint was joined by at least 13 other students, and Bengaluru City Police were examining loans said to total about Rs 18 crore raised in the names of roughly 2,000 students. Those aggregate figures come from the complaint and press coverage, not from any court finding.

The matter is at the investigation stage. No chargesheet has been traced on the public record, no charges have been framed, and no court has recorded any finding of guilt. The Karnataka High Court has since granted anticipatory bail to two persons named in the FIR: a chartered accountant, Arun Kumar S, on 19 July 2023, and a director of the company, Shweta Badami, on 29 November 2023. A grant of anticipatory bail is a protection against arrest during investigation; it is not an acquittal and records no view on the merits.

How It Worked

The mechanism, as the complaint underlying Crime No. 133/2023 describes it, turned on how the course fee was financed. The company is alleged to have marketed a 24-month data-science programme with the assurance that students need not pay from their own pocket: it would arrange an education or personal loan in each student's name against the fee, through third-party lending partners, and would itself service the monthly EMIs in the form of a stipend until the student was placed.

Per the complaint recorded in the High Court orders, the advertisement stated the course carried a "zero cost EMI option with pay after placement programme" and that "they will pay the monthly EMI in the form of stipend". The complainant alleges the loan was processed in his name and that the payments stopped after about one to two months, leaving him personally liable on a loan of more than Rs 2 lakh and exposed on his credit-bureau record.

The procedural sequence on the record runs from the complaint of 29 May 2023, to the registration of Crime No. 133/2023 at Jayanagar Police Station, to the reported arrest of the founder in early June 2023, and then to the two anticipatory-bail petitions decided by the Karnataka High Court under Section 438 of the Code of Criminal Procedure. Press reports at the time also referred to parallel complaints and custody sought by police in Maharashtra and Andhra Pradesh, indicating enquiries beyond Karnataka.

Separately, on the recovery side, a lending partner, Satya Microcapital Limited, brought an arbitration petition against GeekLurn Edutech in the Delhi High Court (ARB.P. 1077/2023), which passed through service and notice stages during 2023 and 2024. That is a civil claim between the lender and the company; its pleadings are one party's assertions, not findings.

Who Lost Money

On the complaint and the press accounts, the people most directly exposed are the students who became the named borrowers. Each is said to have been left personally liable on a loan of over Rs 2 lakh, with the aggregate across roughly 2,000 students put at about Rs 18 crore. Those numbers are as alleged; the court orders reviewed name only the single complainant and do not record an aggregate.

For a student borrower, the practical consequence is twofold: an outstanding balance the lender can pursue, and an adverse entry on the credit record maintained by the bureaus, which can affect future borrowing regardless of how the dispute with the edtech is resolved. Whether the lending partners continued to treat the students as the borrowers of record, or looked instead to the company, is exactly what the arbitration and any settlement will determine.

No recovery or restitution to students has been established on the public record. The lender's arbitration against the company is a route to recover what it says it is owed; it is not, by itself, relief for the individual borrowers.

Where It Stands Now

As of today, Crime No. 133/2023 remains an investigation. No chargesheet, framing of charges, or conviction relating to it could be located on the public record. The two anticipatory-bail orders stand: Arun Kumar S (19 July 2023) and Shweta Badami (29 November 2023), each on a personal bond of Rs 1,00,000 with conditions to cooperate with the investigation. Anticipatory bail leaves the investigation live; it does not close it and does not decide the allegations.

The Delhi High Court arbitration (ARB.P. 1077/2023) between the lender and the company proceeded through 2024 on questions of service and reply, a separate civil track from the criminal investigation.

Because the matter is pre-conviction, the presumption of innocence applies in full. A first information report and the allegations in a complaint contain accusations, not findings of guilt; the persons named are presumed innocent until proven guilty, and due process continues.

What It Means

This matter is a template for the "deferred-fee" or income-share exposure that sits inside some upskilling offers. The point that survives the specific dispute is a simple one: when a loan is taken in your name, you are the borrower of record, and the liability and the credit-bureau entry attach to you, whatever a third party has promised about paying the EMIs. A promise to service the instalments is only as good as the party making it.

Before signing anything sold as "zero cost" or "pay after placement", it is worth confirming who the lender is, who the agreement names as borrower, what happens to the loan if the course provider stops paying, and whether the arrangement is recorded in writing.
